1. About the Program

The Thirsty Monkey Loyalty Program (the “Program”) is operated by Thirsty Monkey (“Thirsty Monkey”, “we”, “us” or “our”).

These Terms & Conditions govern your participation in the Program through the Thirsty Monkey app (the “App”).

By creating an account or participating in the Program, you agree to these Terms & Conditions.

The Program is available at participating Thirsty Monkey stores across Australia.

2. Membership

Membership is free and available to eligible customers.

To participate in the Program, you must:

• Create an account through the App.

• Provide accurate and current information when registering.

• Maintain the security of your account and login details.

Each member may maintain one loyalty account. Membership is personal and cannot be transferred to another person.

You are responsible for activity conducted through your account and must notify us if you believe your account has been accessed without your permission.

We reserve the right to suspend or terminate accounts where we reasonably believe there has been fraudulent activity, misuse of the Program or a breach of these Terms & Conditions.

3. Earning Points

Members earn loyalty points on eligible purchases made at participating Thirsty Monkey stores.

The current earning rate is:

$2 AUD spent = 1 loyalty point.

Points are calculated based on the eligible transaction amount after discounts and excluding any amounts paid using loyalty rewards.

Points are not earned on:

• The purchase of gift cards.

• The redemption of loyalty rewards.

• Cancelled or refunded transactions.

• Any other purchases or transactions we specify as ineligible.

Points will generally be credited to your account following an eligible purchase.

You must identify your loyalty account at the time of purchase to earn points. Points cannot be retrospectively credited unless we approve the request.

The applicable points calculation and any rounding rules will be reflected in the App or communicated by Thirsty Monkey.

4. Redeeming Points for Rewards

Members can redeem accumulated points for rewards through the App.

The standard points redemption rate is:

50 loyalty points = $10 AUD reward.

Members may accumulate multiple rewards. For example:

• 50 points = $10 reward.

• 100 points = 2x $10 reward.

Each $10 reward redemption deducts 50 points from the member's account. Any remaining points will stay in the account and can be accumulated towards future rewards.

Unless otherwise stated, rewards:

• Are valid for 3 months from the date of issue.

• Must be redeemed before the displayed expiry date.

• Can be redeemed at participating Thirsty Monkey stores across Australia.

• Cannot be exchanged for cash.

• Cannot be transferred to another member.

• Cannot be reissued once redeemed or expired, except where required by law.

Members may redeem multiple $10 reward vouchers in a single transaction, provided the total reward value does not exceed the purchase amount.

Where multiple rewards are issued, each reward will have its own expiry date based on its individual issue date.

5. Special Rewards and Exclusive Offers

In addition to standard points-based rewards, Thirsty Monkey may offer members access to special rewards, exclusive experiences, promotions and other benefits from time to time.

These may include, but are not limited to:

• Concert tickets and live entertainment experiences.

• Exclusive merchandise or limited-edition products.

• Invitations to special events or experiences.

• Birthday rewards and special occasion offers.

• App-exclusive promotions and discounts.

• Complimentary products or other surprise rewards.

• Other rewards or experiences determined by Thirsty Monkey.

Special rewards may be offered through promotional campaigns, loyalty activity, member engagement, special occasions or other eligibility criteria determined by Thirsty Monkey.

Special rewards may be offered at Thirsty Monkey's discretion and are not guaranteed or available at all times.

Unless otherwise specified, special rewards:

• Are subject to availability and applicable eligibility requirements.

• Cannot be exchanged for cash or an alternative reward.

• Cannot be transferred or resold.

• May be subject to separate terms and conditions.

• May be subject to additional conditions imposed by third-party reward providers.

Where a special reward has specific redemption requirements, these will be communicated at the time of the offer.

Thirsty Monkey reserves the right to determine the nature, availability and eligibility requirements of special rewards.

6. Points Expiry

Loyalty points do not expire while the Program remains active.

Points are not cash and cannot be exchanged for cash.

If you close your account, any unredeemed points may be forfeited, subject to applicable law.

7. Refunds and Cancellations

If a purchase is refunded or cancelled, any loyalty points earned from that transaction may be deducted from your account.

If a reward was redeemed against a transaction that is subsequently refunded, we may adjust your loyalty account to reflect the refunded transaction.

We will not make adjustments that would unlawfully reduce your rights under the Australian Consumer Law.

8. Program Availability

The Program is intended to operate across participating Thirsty Monkey stores throughout Australia.

Your loyalty account and points balance are linked to your membership, not to a specific store.

You may earn points at one participating store and redeem rewards at another participating store.

Program availability may be affected by temporary technical issues, system outages, store closures or other circumstances beyond our reasonable control.

9. Changes to the Program

We may update these Terms & Conditions or modify the Program from time to time.

Where changes materially affect members, we will take reasonable steps to notify members in advance.

We will not retrospectively remove accrued points or alter the value of existing rewards without reasonable notice, except where required by law or necessary to address fraud, errors or other exceptional circumstances.

If the Program is discontinued, we will provide reasonable notice and an opportunity for members to redeem their accrued points, subject to applicable law.

10. Misuse of the Program

You must not:

• Create multiple accounts to obtain additional points or rewards.

• Manipulate transactions to earn additional points.

• Use the Program for fraudulent or unlawful purposes.

• Sell, transfer or trade loyalty points or rewards.

• Attempt to interfere with the operation of the App or Program.

We may suspend or terminate membership where we reasonably believe these Terms & Conditions have been breached.

11. App Availability and Technical Issues

We aim to keep the App and Program available, but we do not guarantee uninterrupted access.

Technical errors, system outages or processing delays may affect the availability of points, rewards or account information.

If an error affects your loyalty balance or reward, please contact us so we can investigate and, where appropriate, correct the issue.

12. Privacy

Your personal information is collected, used and managed in accordance with our Privacy Policy. You can access our Privacy Policy at any time through the Thirsty Monkey app or on our website.

By using the app and participating in the loyalty program, you acknowledge that you have had the opportunity to review our Privacy Policy.

13. Australian Consumer Law

Nothing in these Terms & Conditions excludes, restricts or modifies any consumer guarantee, right or remedy available under the Australian Consumer Law or other applicable legislation.

To the extent permitted by law, we exclude liability for losses arising from circumstances beyond our reasonable control.

14. Governing Law

These Terms & Conditions are governed by the laws of New South Wales, Australia.

You agree that any disputes arising in connection with the Program will be subject to the jurisdiction of the courts of New South Wales, subject to any applicable consumer rights.
